Techier acts as the Data Fiduciary under the Digital Personal Data Protection Act, 2023 (India), responsible for processing personal data on the Exelara platform.
3. SCOPE OF POLICY
This Policy applies to Job Seekers (Candidates), Employers & Recruiters, Website visitors, and Business partners and service users.
4. DATA WE COLLECT
4.1 Information You Provide
We may collect:
- For Candidates: Name, email, phone number, Resume/CV, skills, experience, education, and interview responses.
- For Employers: Name, company name, contact details, job postings, and hiring requirements.
4.2 Automatically Collected Data
- IP address, device, and browser type.
- Pages visited and usage behavior.
- Cookies and tracking data.
4.3 Sensitive Data
We do not intentionally collect sensitive personal data. If such data is uploaded by users, it is done at their own discretion.
5. HOW WE USE YOUR DATA
- Provide and operate the platform.
- Enable job matching and recruitment.
- Perform AI-based analysis and interview evaluation.
- Improve platform performance and user experience.
- Comply with legal obligations.
6. AI DATA PROCESSING
Exelara uses AI technologies to analyze resumes, conduct interviews, and generate candidate insights. AI outputs are automated and indicative only; final decisions are made by human employers.

8. DATA SHARING
We do not sell your personal data. We may share data with Employers (for recruitment), trusted service providers, or legal authorities if required by law.
9. DATA RETENTION
We retain your data up to 3 years from last activity or as required by law. After this, data is securely deleted or anonymized.

We implement reasonable security measures including secure servers and infrastructure. However, no system is completely secure.

1. Terms & Conditions
1.1 Acceptance of Terms
By accessing or using Exelara, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
1.2 Eligibility
You must be at least 18 years old to use Exelara. By registering, you confirm that all information provided is accurate and up to date.
1.3 Account Responsibility
You are responsible for:
- Maintaining confidentiality of login credentials
- All activities under your account
Exelara is not liable for unauthorized access due to your negligence.
1.4 Acceptable Use
You agree NOT to:
- Post fake or misleading job listings
- Upload false candidate information
- Harass, abuse, or harm others
- Use the platform for illegal purposes
- Attempt to copy, scrape, or reverse-engineer the platform
1.5 User-Generated Content License
By submitting content (including resumes, profiles, job posts), you grant Exelara and Techier a non-exclusive, worldwide, royalty-free license to:
- Store and process your content
- Display it to relevant users
- Use it for AI-based matching and analysis
You confirm you have the legal right to share this content.
1.6 AI Disclaimer
Exelara uses AI to assist in candidate evaluation, job matching, and interview analysis. However:
- AI outputs are indicative only
- We do not guarantee accuracy, fairness, or completeness
- Final hiring decisions are solely the Employer’s responsibility
1.7 Job Listings Disclaimer
Exelara does not verify all job postings. We are not responsible for fraudulent listings or misleading offers. Users must conduct their own due diligence.
1.8 Platform Availability
We do not guarantee uninterrupted service or error-free performance. Services may be interrupted due to maintenance, technical issues, or external factors.
1.9 Intellectual Property
All platform content including the brand name (Exelara), logo, software, and AI systems are owned by Techier. Unauthorized use is strictly prohibited.
1.10 Third-Party Services
We may use third-party tools (payment gateways, analytics). We are not responsible for their performance or policies.
1.11 Account Suspension
We may suspend or terminate accounts that violate these terms or engage in fraudulent or harmful activities.
1.12 Indemnity
You agree to indemnify and hold harmless Exelara and Techier from any claims, damages, or losses arising from your use of the platform.
1.13 Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Total liability shall not exceed the amount paid by you.
1.14 Governing Law
These Terms are governed by Indian law. Jurisdiction: Courts of Surat, Gujarat.
1.15 Changes
We may update these Terms at any time. Continued use means acceptance.
2. Refund Policy
2.1 General Rule
All payments made on Exelara are non-refundable.
2.2 Nature of Services
Our services are digital (AI matching, job visibility, interviews) and are activated instantly, making refunds impractical.
2.3 Exceptions
Refunds may be considered if the service was not delivered due to our technical error. Requests must be made within 7 days of payment.
2.4 Cancellation
- Subscriptions can be cancelled anytime
- Cancellation applies from next billing cycle
- No partial refunds
2.5 Payment Gateway Disclaimer
We are not responsible for payment failures or bank/gateway errors.
2.6 Legal Compliance
Nothing in this policy overrides rights available under applicable law.
4. Terms of Use & Undertaking
4.1 User Responsibility
You agree that all information provided is accurate, you will not impersonate others, and you will comply with all applicable laws.
4.2 Content Responsibility
You are solely responsible for your content. Exelara is not liable for user-generated content.
4.3 Confidentiality
You agree not to misuse candidate data or employer data. All such information must be used only for intended purposes.
4.4 AI Interview Undertaking
By using AI interview features, you understand results are automated, agree they are not final decisions, and accept limitations of AI evaluation.
4.5 Data Protection Compliance
We comply with the Digital Personal Data Protection Act, 2023 and the IT Act, 2000.
4.6 Grievance Officer
Contact: support.team@exelara.com. Response within 24 hours; resolution within 15 working days.
4.7 Dispute Resolution
First: mutual resolution. Then: arbitration in Surat, Gujarat, governed by the Arbitration & Conciliation Act, 1996.
4.8 Limitation
We are not responsible for hiring outcomes, employment disputes, or business losses.
4.9 Updates
We may update these terms anytime.
